The Kentucky Supreme Court today struck down the 2017 law requiring victims of medical malpractice to first file their case before a “panel” of doctors, before they can exercise their right to go to Court to achieve justice.
As a Board Certified Medical Malpractice Specialist, certified by the American Board of Professional Liability Attorneys (APBLA.org) I have witnessed firsthand the injustice which delay imposes on victims of medical malpractice. Requiring a victim to file with the Panel added at least 2 years of delay to the usual 2 years to get a case from filing of the lawsuit in Court to the stage of a jury trial.
