The Plaintiff, Brian Moss, suffered a serious on-the-job injury and retained attorney Mark Beal to secure his workers compensation benefits. Attorney Beal failed to file the Plaintiff's workers compensation claim within the time allowed by law, and the claim was rejected as barred by the statute of limitations. The Plaintiff filed a legal malpractice lawsuit against his former attorney seeking damages caused by the attorney's negligence. After a bench trial on the issue of damages the court awarded the Plaintiff $205,960, including $125,000 for past and future emotional distress for resulting from the attorney's negligence.
