What Is Medical Malpractice?

A legal duty exists whenever a hospital or health care provider undertakes care or treatment of a patient. Medical malpractice is professional negligence by act or omission by a health care provider in which care provided deviates from accepted standards of practice in the medical community and causes injury or death to the patient. A recent study by the National Academy of Sciences - Institute of Medicine estimated that as many as 98,000 patients may be killed each year in hospitals alone as a result of medical errors and does not mention how many more may be injured due to medical malpractice.

How Can I Avoid Medical Malpractice?

Here are some simple steps you can take as a patient to reduce the risk of medical malpractice.

  1. See what other people think about your doctor. There are many online resources like this one where you can view a doctor's rating. If other people have had bad experiences, there is a possibility you might as well.
  2. Be involved. You have a right to ask questions about your medical care. If you do not communicate with your doctor, you will be more at risk for medical malpractice.
  3. Do not withhold medical information. Not providing your health care provider with detailed and accurate information about medical history impeded their ability to treat you and can jeopardize your own health.
  4. Trust your instincts. If you feel there is something wrong when your doctor says everything is fine, do not be afraid to get a second opinion.
