When a client receives a verdict or settlement is "not what they expected", it does not necessarily mean the lawyer representing them committed legal malpractice. An attorney is to act in the best interests of his/her client. A retainer agreement is a contract that defines the relationship between the lawyer and client. This agreement between the lawyer and client outlines the role, expectations and obligations of each party. If your lawyer failed to meet his/her obligations they are in breach of contract and possibly liable for legal malpractice.

All attorneys are expected to exercise the degree of care and skill expected of a “reasonably competent attorney,” under similar circumstances, in the performance of all work relevant to a case. If your attorney failed to exercise the degree of care and skill of a reasonably competent attorney, the attorney may be negligent and liable for legal malpractice. If an attorney presents him/herself to be an expert or specialist in an area of law, the standard of care is that of an “reasonably competent” expert or specialist in the field.

  1. Are you board certified as a specialist? Board certifications are in place to provide clients with added piece of mind and recognize attorneys that exceed the standards in their field.
  2. Have you ever taken a case like mine before jury? Whether your case involves personal injury, medical malpractice or an automobile accident the attorney you select should be ready for trial by jury should a settlement not be reached.
  3. What are some of the past verdicts and settlements you have received? Track records are important, you would not hire someone who has never worked on a car as a mechanic. Never hire a lawyer can not show proven results in your type of case.
